A consumer is a natural person purchasing outside the scope of their business activity. Mandatory consumer rights always take precedence over any conflicting provision of these Terms.
Products
Product descriptions, photographs, and colour previews aim to represent each product faithfully. Appearance may nevertheless vary slightly depending on the screen, lighting, material, or production batch. Minor variations consistent with the nature of textiles do not in themselves constitute a defect; this does not affect statutory rights arising from defective performance.
BUNDA may update product information, availability, and its product range or discontinue a product. The information available when the order is submitted and the subsequent confirmation are decisive.
Prices
Prices are stated in Czech koruna. The valid price is the price displayed when the order is created and confirmed by the payment system. Any delivery costs or other mandatory charges are shown to the customer before the order is completed.
An obvious technical error or manifestly nonsensical price does not automatically create an obligation to supply goods at the incorrect price. In such a case, we will contact the customer without undue delay and propose a correction, or cancel the order and refund any payment already received.
Payment
Card payments are processed by Stripe. We begin processing an order only after successful payment has been confirmed, unless expressly agreed otherwise. BUNDA does not store complete payment card details.
Delivery
Available delivery methods and any delivery charge are shown during the ordering process. The stated delivery date is an estimate, not an absolute guarantee, unless a binding date follows from law or an express agreement.
We are liable for delays caused by circumstances outside our reasonable control only to the extent required by law. We will endeavour to inform the customer of any significant delay and will always respect their mandatory consumer rights.
Receipt of the shipment
We recommend checking the condition of the shipment on receipt and documenting and reporting any visible damage to both the carrier and BUNDA as soon as possible. A later report does not in itself result in the loss of statutory rights arising from defective performance.
Withdrawal from the contract
Unless the law provides otherwise, a consumer may withdraw from a distance contract without giving a reason within 14 days of receiving the goods. To exercise this right, it is sufficient to send an unambiguous notice to contact@bundawear.cz within the applicable period.
Returned goods should be complete and adequately protected against damage. The consumer is liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. The customer bears the direct cost of returning the goods unless the law or a specific BUNDA offer provides otherwise.
Sealed goods for hygiene reasons
For sealed goods that are not suitable for return for hygiene reasons, the statutory exception to the right of withdrawal may apply only after the hygiene seal has been broken. This exception does not automatically apply to all underwear or to goods that were not appropriately sealed.
Complaints and defects
BUNDA is liable for defects to the extent provided by law. Complaints may be submitted to contact@bundawear.cz; please include the order number, a description of the defect, and, where possible, a photograph. We will assess and handle the complaint in the manner and within the time limits prescribed by law.
Normal wear and tear is not a defect. Damage caused by improper care, use contrary to instructions, unsuitable intervention, or mechanical damage may not constitute a defect. The nature of the product, customary use, and care instructions will be considered in the assessment.
Refunds
We issue refunds within the statutory period and by the method required by law, generally using the same payment method used by the customer unless agreed otherwise. Where permitted by law, we may wait to issue the refund until we receive the goods or the customer provides evidence that they have been sent.
Discounts and promotions
Unless stated otherwise for a specific campaign, discounts and promotional codes cannot be combined and may be limited in duration, scope, or number of uses. Clearly communicated terms of a specific campaign take precedence. BUNDA may reject obvious misuse of a promotion; payments already received will be settled accordingly.
Misuse of the service
Automated attacks, fraudulent orders, manipulation of the payment process, circumvention of technical restrictions, and unauthorised interference with the website are prohibited. We may block such conduct and cancel the related order with the appropriate financial settlement. This does not affect the right to compensation for any loss suffered.
Intellectual property
The BUNDA brand, photographs, graphics, text, and website design are protected by applicable rights. They may not be copied, modified, distributed, or used commercially without consent beyond what is permitted by law.
Limitation of liability
To the extent permitted by law, BUNDA is not liable for indirect issues caused by outages of third-party services, temporary website unavailability, or circumstances outside its reasonable control. This provision does not exclude or limit any liability or rights that cannot be excluded or limited by law.
Force majeure
We are liable for a breach caused by an extraordinary, unforeseeable, and insurmountable obstacle outside our reasonable control only to the extent provided by law. As soon as reasonably possible, we will take appropriate steps to mitigate the consequences.
Changes to these Terms
We may amend these Terms for future orders. A contract already concluded is governed by the version effective when it was concluded, unless the law requires otherwise. The current version is always published on this page.
Governing law and disputes
Legal relationships are governed by the laws of the Czech Republic. This does not deprive consumers of mandatory rights granted by the law of the country of their habitual residence.
We will first attempt to resolve any consumer dispute by agreement. The competent entity for out-of-court dispute resolution is the Czech Trade Inspection Authority, Štěpánská 796/44, 110 00 Prague 1, website coi.gov.cz.
